When you access or use this online store, you accept these terms and conditions of use and all applicable laws. If you do not accept these terms and conditions, you cannot use this online store.

The following terms and conditions constitute the agreement between Marrakech Glow and the buyer of any product whose use, transactions, and shipping must be made outside Morocco through the Marrakech Glow website www.marrakechglow.com (hereinafter the “Website”).

The buyer is asked to carefully read the terms and conditions before ordering:

Introduction

The buyer accepts the terms and conditions set forth in this online contract (hereafter the “contract”) concerning products and information provided by or via the online store. This contract constitutes the entirety of and unique agreement between Marrakech Glow and the buyer and replaces all agreements, representations, guarantees, and previous or current agreements concerning the products and information provided by or via the online store, as well as the purpose of this contract. The buyer agrees to familiarize himself with this contract before making a purchase. Purchasing a product will be considered acceptance of this contract.

Configuration and Payment

The buyer represents and guarantees that (1) the credit card details provided are true, correct, and complete and (2) the expenses incurred by the Buyer will be honored by the Buyer’s credit card company and (3) the Buyer will pay the expenses he incurs, for the amounts applicable at the time at which they are incurred, including all applicable taxes. The buyer will be responsible for all expenses incurred by the use of his password. The buyer agrees to keep his password confidential and to inform Marrakech Glow within 24 hours of any breach of this contract or any unauthorized use of his password. Marrakech Glow does not protect the buyer from unauthorized use of his password.

Copyright

The content, organization, collection, compilation, magnetic translation, digital conversion, and other elements related to the online store are protected by copyright, trademarks, and other property rights (including, without this being exhaustive, intellectual property rights), and the copying, redistribution, use, or publication of this content or any element of the online store by a buyer is prohibited. Marrakech Glow reserves the right, at its sole discretion, to remove any product available for sale on the online store. As soon as notice is published on the online store, Marrakech Glow can amend this contract or the prices and can suspend or revise all or part of the elements of the online store, at its sole discretion and without notice. Any amendment to this contract will be considered effective as from publication on the online store, for transactions made after this date.

Right of Refusal

Marrakech Glow reserves the right, at its sole discretion, to refuse the service at any time. The sale of any product is subject to availability.

Indemnity

The buyer agrees to indemnify, defend, and protect Marrakech Glow and its affiliates, licensors, and suppliers of any liability, loss, claim, and expenses, including reasonable legal fees, related to the breach by the buyer of this contract or use of the online store.

The Buyer’s Right

The buyer’s right to use the online store cannot be transferred and is subject to the limitations established by Marrakech Glow or by the buyer’s credit card company.

Order Confirmation and Shipping

Once the buyer’s order has been placed, a page appears to confirm that the order has been received. An order confirmation email will also be sent to the buyer shortly after the order is placed. If an order confirmation email is not received within 24 hours, the buyer should contact Marrakech Glow by email at the address contact@marrakechglow.com to obtain assistance. Marrakech Glow orders are shipped on business days (Monday to Friday from 8.30 a.m. to 5.30 p.m., except bank holidays). All orders are subject to authorization. Only authorized orders are processed and shipped. If an order has not been shipped, has been shipped incorrectly, if a product is missing, or an item is damaged or faulty, the buyer should contact Marrakech Glow by email at the address contact@marrakechglow.com to obtain assistance.

Faulty Products

If a product purchased is faulty, the buyer should contact Marrakech Glow within 14 days of receipt thereof by email at the address contact@marrakechglow.com to obtain assistance. In order for the request to be processed, the buyer must provide a detailed description of the fault and provide proof of purchase.

IMPORTANT: Unfortunately, Marrakech Glow does not accept returns. If it is deemed appropriate by Marrakech Glow, online credit corresponding to the total purchase amount will be issued for faulty products.

Comment: This section only concerns products purchased on the online store. Products purchased on the online store cannot be returned to a Marrakech Glow distributor.

Use of Data

Marrakech Glow reserves the right, and the buyer authorizes Marrakech Glow, to use and transfer any data concerning the use of the online store by the buyer, as well as any data provided by the buyer, subject to governing laws.

Governing Law

This contract is governed by Moroccan law.

Disputes

Any legal action arising from this contract or related thereto must be brought in Morocco only. The buyer expressly submits himself to the jurisdiction of said courts and agrees to the extraterritorial notification of the proceedings. If part of this contract is deemed invalid or non-enforceable, this part must whenever possible be construed in accordance with governing law so as to reflect the initial intentions of said parts, and the remaining parts will remain fully in force. If anything on or associated with the online store or Marrakech Glow is in conflict with or incompatible with this contract, this contract will prevail. If Marrakech Glow does not comply with one of the provisions of this contract, this does not constitute a waiver of said provision or the right to ensure it is respected.

Entire Understanding

This agreement constitutes the entire understanding between the buyer and Marrakech Glow concerning the use of the online store and replaces any prior declaration.

Order Limits

The products ordered online are not intended for resale. Marrakech Glow reserves the right to limit the number of orders of items and the total value of the products ordered per day and per month.

Currencies and Sales Taxes

All prices on the online store are in Moroccan Dirham (MAD), Euro (EUR), and US Dollars (USD), depending on the geographical location from which the store is accessed. The buyer accepts that all orders shipped by Marrakech Glow are subject to sales tax, applicable in accordance with the tax code in the country to which the order will be shipped. The tax is estimated at the time of the order, and a final calculation of the actual sales tax will be mentioned on the order confirmation email sent to the Buyer and the delivery slip.

Online Security

All orders placed on the online store are encrypted, protecting all credit card details submitted at the time of the order. By using the most advanced online security technique currently used by consumers, Marrakech Glow can guarantee that all orders are placed in complete security. As such, Marrakech Glow cannot be held liable for direct or indirect harm related to credit card fraud or theft.

Cancellation, Refunds, and Withdrawal

  • Cancellation Policy: Customers may cancel their orders up to 24 hours before the scheduled dispatch. If the product has already been shipped, customers may return the product following the guidelines under the right of withdrawal.

  • Refund Policy: Marrakech Glow offers refunds for products returned within 14 days of receipt, provided the items are returned in their original condition. Refunds will be processed using the same payment method used for purchase unless otherwise requested by the customer.

  • Right of Withdrawal: Customers have the right to withdraw from any purchase within 14 days without providing a reason. This period will start from the day the customer, or a third party indicated by the customer other than the carrier, takes possession of the goods. If exercised, Marrakech Glow will refund the cost of the item and standard shipping costs.
